LMIA Process Explained: Employer & Worker Guide

What is an LMIA?

A Labour Market Impact Assessment (LMIA) is a document that a Canadian employer may need to obtain before hiring a foreign worker. It demonstrates that there is a need for a foreign worker and that no Canadian worker or permanent resident is available to fill the position.

Steps for Employers

  1. Advertisement Requirements: The employer must advertise the position on at least three platforms for a minimum of 4 weeks.
  2. Application Submission: Submit the LMIA application to Employment and Social Development Canada (ESDC) with all required documentation.
  3. Processing: ESDC reviews the application, verifying the employer's compliance and labour market need.
  4. Decision: If approved, the employer receives a positive LMIA, which the worker uses to apply for a work permit.

For Workers

Once your employer has a positive LMIA, you can apply for a work permit at a Canadian visa office. You will need the LMIA number, a copy of the offer of employment, and standard application documents.
